Illegality of Swearing Falsely

باب تغليظ اليمين الكاذبة عمدًا

A false oath is not a small slip of the tongue; it drags the name of Allah into a lie in order to seize what belongs to another. This chapter calls such an oath by its grave name, al-Yamin al-Ghamus, the oath that plunges its swearer into sin and into the Fire. It sits among the major sins precisely because it weaponises sacred speech against a brother's rights.

Notice how the hadith strip away every excuse. The amount stolen does not matter, even a twig of a tree, because the crime is the betrayal of trust and the contempt for Allah's name. Read alongside the verse it cites, the warning is stark: such a person forfeits Allah's address, His look of mercy, and His purification on the Day of Resurrection.

Hadith 1712

Ibn Mas'ud (May Allah be pleased with him) said:

عن ابن مسعود رضي الله عنه أن النبي صلى الله عليه وسلم قال‏:‏ ‏ "‏من خلف على مال امرئ مسلم بغير حقه، لقي الله وهو عليه غضبان‏" ‏ قال‏:‏ ثم قرأ علينا رسول الله صلى الله عليه وسلم مصداقه من كتاب الله عز وجل‏:‏ ‏{‏إن الذين يشترون بعهد الله وأيمانهم ثمنًا قليلا‏}‏ ‏(‏‏(‏آل عمران‏:‏ 77‏)‏‏)‏ إلى آخر الآية‏:‏ ‏(‏‏(‏متفق عليه‏)‏‏)‏‏.‏

The Prophet (ﷺ) said, "He who takes oath to acquire the property of a Muslim unjustly will meet Allah and He will be angry with him" then he recited: "Verily, those who purchase a small gain at the cost of Allah's Covenant and their oaths, they shall have no portion in the Hereafter. Neither will Allah speak to them nor look at them on the Day of Resurrection nor will He purify them, and they shall have a painful torment." (:) [Al-Bukhari and Muslim].

Taking a false oath to seize a Muslim's property unjustly meets Allah's anger. The verse cited warns such people forfeit Allah's mercy on the Day of Resurrection. A false oath drags Allah's name into a lie.

Hadith 1713

Abu Umamah Iyas bin Tha'labah Al-Harithi (May Allah be pleased with him) said:

وعن أبي أُمامة إياس بن ثعلبة الحارثي رضي الله عنه أن رسول الله صلى الله عليه وسلم قال‏:‏ ‏"‏من اقتطع حق امرئ مسلم بيمينه، فقد أوجب الله له النار‏.‏ -وحرم عليه الجنة‏"‏ فقال له رجل‏:‏ وإن كان شيئًا يسيرًا يا رسول الله‏؟‏ قال‏:‏ ‏"‏وإن كان قضيبًا من أراك‏"‏ ‏(‏‏(‏رواه مسلم‏)‏‏)‏‏.‏

The Messenger of Allah (ﷺ) said, "He who misappropriates the right of a Muslim by taking a false oath, Allah will condemn him to the fire of Hell and will forbid Jannah for him." A person asked: "O Messenger of Allah, even if it is something insignificant?" He replied, "Yes, even if it is the twig of the Arak tree." [Muslim].

In plain words

Whoever wrongly takes another Muslim's right by a false oath is warned of the Fire, even if what was taken is as small as a twig. The amount does not lessen the betrayal of trust.

Hadith 1714

'Abdullah bin 'Amr bin Al-As (May Allah be pleased with them) said:

وعن عبد الله بن عمرو بن العاص رضي الله عنهما عن النبي صلى الله عليه وسلم قال‏:‏ ‏ "‏الكبائر‏:‏ الإشراك بالله، وعقوق الوالدين، وقتل النفس، واليمين الغموس‏" ‏ ‏(‏‏(‏رواه البخاري‏)‏‏)‏‏.‏ وفي رواية‏:‏ أن أعرابيًا جاء إلى النبي صلى الله عليه وسلم فقال‏:‏ يا رسول الله ما الكبائر‏؟‏ قال‏:‏ ‏ ‏الإشراك بالله‏ ‏ قال‏:‏ ثم ماذا‏؟‏ قال‏:‏ ‏ ‏اليمين الغموس‏ ‏ قلت‏:‏ وما اليمين الغموس‏؟‏ قال‏:‏ ‏ ‏الذي يقتطع مال امرئ مسلم‏ ‏ يعني بيمين هو فيها كاذب

The Prophet (ﷺ) said, "Of the major sins are: Associating anything in worship with Allah, disobedience to the parents, killing without justification and taking a false oath (intentionally)." [Al- Bukhari]. Another narration is: A bedouin came to the Prophet (ﷺ) and asked him: "O Messenger of Allah, what are the cardinal sins?" He (ﷺ) replied, "Associating anything with Allah in worship." The man asked: "(What is) next?" The Messenger of Allah (ﷺ) replied, "Al-Yamin Al-Ghamus." He asked: "What do you mean by Al-Yamin Al-Ghamus?" The Messenger of Allah (ﷺ) replied, "Swearing falsely to usurp the property of a Muslim."

Among the major sins listed are setting up partners with Allah, disobedience to parents, killing without right, and the deliberate false oath used to seize a Muslim's property. Such an oath is named a grave sin.
